Summary The purpose of the project is to analyze the sanctions apparatus in the Norwegian fisheries administration. Sanctions are the measures the authorities have at their disposal when the practitioners in the fishing industry have violated the regulations. The topic is interesting, among other things, in recent years' focus on offenses within this industry. The area has been given its own concept: "fish cheating". In part 1 of the project, the main features of Norwegian fisheries management will be described, including history, structure and the competence of the various bodies. Parts of the regulations that apply to practitioners; the coastal fleet, the sea-going fleet and the buyer in the first place, will also be treated. Furthermore, an account will be given of the principles / considerations on which Norwegian fisheries management is based. Sustainable development is a stated consideration. In Ot.prp. no. 92 (2000-2001) it is stated i.a. that "the living marine resources are renewable, but not inexhaustible. Harvesting and other activities must therefore be carried out in a way that ensures responsibility and long-term sustainability for the future". In part two, we will analyze the content of the various sanctions; penalties (fines and imprisonment), confiscation (of value and gear) and administrative sanctions (loss of the right to engage in commercial fishing or be registered as a buyer). The last part will be a forensic sociological / political assessment of the significance of the regulations and sanctions for practitioners, and of whether the regulations should be changed.
Main objective: Analyse the prescriptive and enforcement regime applicable to foreign flagged vessels in marine areas subjected to Norwegian jurisdiction. Sub-objectives: (1) To discuss the content of the international legal rules for coastal state jurisdiction over foreign flagged fishing vessels; (2) To discuss the prescriptive and enforcement regime foreign flagged vessels are subjected in areas under Norwegian coastal state jurisdiction; (3) To discuss whether the Norwegian regime is consistent with the international legal obligations and utilizes the opportunities provided.
